Our client was driving in Miami-Dade County when another driver made an improper left turn and violently struck his vehicle. The crash was captured on video. Our client suffered one of the most extensive facial fracture patterns a trauma team can encounter -- fractures to the mandible, zygomatic arch, bilateral maxillary sinuses, nasal bones, both orbital floors, both orbital walls, and the pterygoid plates. He required a tracheostomy due to the severity of his facial injuries. His jaw was wired shut to allow healing. The at-fault driver carried only minimal bodily injury coverage. Mausner Group exhausted those limits and then turned to our client's own uninsured motorist coverage. Total recovery across all carriers was $270,000.
When the at-fault driver's coverage is inadequate, Florida's uninsured motorist statute provides a critical additional layer of protection. Mausner Group moved simultaneously against both the at- fault carriers and our client's own UM carrier, demanding policy limits from each and presenting the video evidence and medical records that made any denial of the severity of the injuries impossible. The medical documentation in this case was overwhelming and Mausner Group secured the maximum available recovery of $270,000 across all three carriers.
