Our client, a 57-year-old man, was driving when another driver ran a stop sign and slammed into the front driver side of his vehicle. The at-fault driver was cited for the violation. MRI imaging revealed multi-level cervical disc herniations from C2 through C7, several of which were encroaching on the spinal cord. His left shoulder showed a partial rotator cuff tear. He developed bilateral carpal tunnel syndrome and underwent left carpal tunnel release surgery. Two independent orthopedic surgeons both recommended anterior cervical discectomy and fusion at multiple cervical levels. He was also diagnosed with TBI and developed PTSD. The at-fault driver was significantly underinsured. Mausner Group exhausted those limits and then pursued our client's own underinsured motorist coverage, securing a global settlement of $315,000.
When the at-fault driver's coverage is inadequate to compensate for serious injuries, maximizing recovery requires identifying and pursuing every available source of insurance. Mausner Group moved simultaneously against the at-fault carrier and the UM carrier, building a damages package that reflected the true and lasting scope of our client's injuries. The damages case was built around objective MRI findings across multiple spinal regions, two independent surgical recommendations for ACDF neck surgery, the completed carpal tunnel surgery, and the documented TBI and PTSD diagnoses.
